3 stars 'The Throat Of Winter' - Opeth (Single)

Written originally for the God Of War III video game soundtrack, Opeth's 'Throat Of Winter' does remain an intriguing footnote for the Swedish progressive metal titans. After 'Watershed', it was clear that Mikael Akerfeldt was going to change up the style of the band to something else, but it was not yet clear as to what the band would do next. Indeed, 'The Throat Of Winter' is something of an indicator as to the new, non-metal direction that Opeth would be taken in. Described by Akerfeldt as 'strange', I would tend to agree. Compared to the fairly harmonious and beautiful acoustic passages that Opeth is used to playing, this is an acoustic song from the band that is fairly creepy and exotic, even making use of some brief psychedelic effects for good measure. While this track is quite a bit shorter than most Opeth tracks, there is still quite a lot going on here, with constantly changing ideas brought on by the acoustics. Mikael's voice also makes an appearance, but it is not for long, instead letting the acoustics do the trick. 'The Throat Of Winter' is a fairly pleasant and interesting track from Opeth, and certainly unexpected, but certainly not one of their songs that will stand the test of time.

Clinton raises concern over flashpoint Sudan region (AFP)

WASHINGTON (AFP) ? US Secretary of State Hillary Clinton railed Monday against reports of serious human rights abuses and ethnic violence in Sudan's flashpoint border province of South Kordofan.

While Clinton welcomed the passage at the UN Security Council of a resolution ordering the deployment of 4,200 peacekeepers to the neighboring Abyei region, she said she was "deeply concerned" by events in South Kordofan.

"Tens of thousands of people have been driven from their homes, and there are reports of very serious human rights abuses and violence targeting individuals based on their ethnicity and political affiliation," Clinton said.

"We urge the parties to reach an immediate ceasefire and to provide aid workers with the unfettered access required to deliver humanitarian assistance to innocent civilians affected by the conflict," her written statement said.

North and south Sudan fought a two-decade civil war in which two million people died. A 2005 peace accord, the Comprehensive Peace Agreement, ended the conflict and allowed for a referendum in January in which the south voted massively to split from the north.

Abyei did not take part in the referendum because the two sides could not agree who should be eligible to vote.

Major worries remain ahead of South Sudan's independence day particularly because of the new conflict in South Kordofan, on the northern side of the border, where troops and their allies are fighting forces loyal to south.

Pakistan drone attacks 'kill 15'

Two US drone missile attacks have killed at least 15 people in the Pakistani tribal region bordering Afghanistan, officials say.

Twelve people were killed when a drone fired two missiles at a compound used by suspected militants in North Waziristan on Monday night, they added.

Earlier on Monday, another drone fired two missiles at a vehicle in North Waziristan, killing three people.

North Waziristan has been targeted by drone strikes for months.

The US says the region is home to several militant groups involved in attacks on Nato forces in Afghanistan.

On Monday night, drone missiles targeted a compound at the foot of a hill in the thickly-forested Mantoi area, some 40km (24 miles) north-west of Miranshah, the main town in North Waziristan.

The compound was being used by local militants affiliated with Hakimullah Mehsud's Tehrik-e Taliban group, officials said.

Earlier, three people were killed and two others injured when a drone fired two missiles at a vehicle which was travelling into Afghanistan in the Shawal region of North Waziristan.

Wazir tribespeople inhabit both sides of the border here and frequently move across the border.

But officials told BBC that those killed in the strike were militants. It is not clear which group they belonged to.

Drone attacks have focused on North and South Waziristan, where US officials believe many al-Qaeda and Taliban fighters find shelter.

Pakistan publicly criticises drone attacks, saying they fuel support for militants. But observers say the authorities privately condone the strikes.

The American military does not routinely confirm drone operations, but analysts say the US is the only force capable of deploying such aircraft in the region.

Your mission, should you choose to accept it, is to watch the brand-new trailer for Tom Cruise's Mission: Impossible -- Ghost Protocol. It's been 15 years since Cruise tackled his first big-screen Mission: Impossible (man, are we that old?) and five years since his last, 2006's Mission: Impossible III. That one sure could have been Ethan Hunt's swan song: He saved the day, married the lovely Julia (Michelle Monaghan) and hinted that his days as an IMF (that's Impossible Missions Force, for the uninitiated) agent were over. But as well all know, international spies don't just get to walk off into the sunset.

In Ghost Protocol, things aren't looking quite so peachy for Cruise's Hunt. His gorgeous wife is nowhere to be found (perhaps she ditched him because he's one of those guys who's married to his job?); he and all his fellow IMF agents have been "disavowed" (i.e. hung out to dry) by the president because they're suspected of having blown the Kremlin to kingdom come; and they must prove their innocence.

Joining Cruise for the fun is a crack team of disavowed agents, including the hilarious computer whiz Benji (Simon Pegg, reprising his role from M:I:3), as well as three new agents. There's stunning Paula Patton, who's a tad more badass here than she was in Precious, and beloved Lost bad boy Josh Holloway, who we're hoping (and betting) survives that guns-blazing leap off a building depicted in the trailer. And, finally, there's the mysterious Brandt (The Town Oscar nominee Jeremy Renner), who may not be what he seems -- but is likely one of the good guys, since he's reportedly taking over for Cruise as the franchise star after this installment.

High-octane car chases, hand-to-hand combat, an awesome cast and a Tom Cruise dangling off the world's tallest man-made structure? Mission accepted.

Twelve Steps to Negotiating a Bridge to Retirement

ACTUAL CASE HISTORY: Alex had been employed in the Information Technology (?I.T.?) department of a large insurance company for 20 years. At 54 years of age, he was looking forward to retirement in just a few years. His wife, Barbara, had recently retired as a school teacher in a private school, and the two looked forward to traveling and spending more time with their grandchildren. Alex was just 11 months away from being able to retire with full pension and, more important to Alex and Barbara, his employer?s Retiree Medical Plan, which provided for lifetime medical coverage at minimal expense. Barbara had no such plan at her school, and Alex had serious kidney problems that suggested he would face large medical bills in the future.

Unfortunately, Alex was chosen to be among about two hundred employees being let go as part of the company?s outsourcing of its I.T. functions to a company in Pakistan. Alex knew that his being selected for downsizing was nothing personal against him, as the entire department was being disbanded as part of a company-wide move to lower payroll costs. It just seemed to come at the worst possible time. Alex immediately asked his Human Resources representative if there was any way that he might get the retiree medical benefits. Her answer was as swift as it seemed certain: ?No, I?m sorry, there?s absolutely nothing at all that can be done.? He and Barbara consulted our firm from their home state of Iowa to see if we might be able to help.

What Alex needed and surely deserved is most often called a ?bridge to retirement,? that is, some mechanism ? any mechanism ? to get him from ?non-qualified? to ?qualified? status for full retiree treatment. We see this problem with considerable frequency.

After reviewing with Alex and Barbara all of the relevant facts, events and circumstances, we sent them on a search for more information. What they learned held the key to negotiating to get Alex the full retiree benefits he and Barbara sought. First, they learned that two senior executives (one an executive vice president, one a senior vice president) had received their own ?bridges to retirement? during the last year. Second, they learned that a few of Alex?s colleagues were being kept on board by the company, but re-assigned to different departments. Most importantly, Alex learned it was growing more likely that the company in Pakistan that was to take over his employer?s I.T. functions might not be ready to do so for another six months.

We assisted Alex in preparing an email letter to his employer?s Chief Operating Officer, outlining Alex?s arguments that he should receive the benefits of full retirement status. His letter focused on three topics: (a) the company needed at least some I.T. professionals to stay on longer than originally estimated; (b) the company needed at least some I.T. professionals to continue working, but assigned to different departments, and (c) the company obviously recognized the concept and the fairness of providing a ?bridge to retirement? to those who had given long-term and faithful service, as demonstrated in how they treated the ?higher up?s.?

Though it took a few weeks to get the response, Alex did receive notification that his departure date would be later than originally thought, in fact 12 months later, giving him precisely what he needed. He and Barbara were surprised how relatively easy it seemed to achieve their ?bridge to retirement? goals, after what had just weeks earlier seemed like a hopeless, lost cause. We weren?t surprised, because we have many times helped clients negotiate their own ?bridges to retirement.? Our experiences in negotiating ?bridges to retirement? have led us to conclude that the most difficult aspect of doing so is simply counteracting Human Resources? insistence that it?s not possible, and convincing our client that it is. While achieving bridging to retirement is not always easy, with so much at stake, it?s shameful not to try.

LESSON TO LEARN: If, just before you are scheduled to achieve full vesting in a company pension, or earning retiree medical benefits, or some other significant employee benefit ? you are fired, downsized or laid off, don?t presume you?re out of luck and without recourse. To the contrary, there is every good chance that you can negotiate to receive what, otherwise, you were scheduled to soon receive. By requesting the accommodation of a ?bridge to retirement,? and supporting that request in one of the following twelve (12) ways, you can often achieve what you?ve been told is not possible. And, bear in mind too, that in making a request for a ?bridge to retirement? you have nothing to lose and everything to gain.

WHAT YOU CAN DO: Over the years we?ve found the following twelve (12) steps and measures to be particularly helpful in gaining ?bridge to retirement? for our clients:

1. Are All Calculations Correct? When faced with ?bridge to retirement? issues, the first thing we consider is ?What are the correct numbers?? You might find it hard to believe, but we?ve seen mistakes made in figuring out how many years the employee worked for the employer, mistakes made in how old the employee actually is, and mistakes made in adding the two together. While such arithmetic is at par with the lessons learned in third grade, that doesn?t preclude errors. More complicated calculations regarding years of service, final or average compensation, and the like are common, too. You can?t even assume that calculations made by a computer are correct, because the numbers input into the computer may, themselves, be in error.

2. What Does the Plan Say About Calculations? Our second step in analysis is to review the wording of the retirement or pension Plan itself. We carefully review Plan provisions to determine precisely how many days, weeks, months or years are needed to ?cross the bridge.? More than once we?ve found that Human Resources and our clients have both miscalculated.

For example, a Retirement Plan may provide that an employee receives ?credit? for a year?s employment only if he or she worked from January 1 through December 31 of that calendar year. Alternatively, a Retirement Plan may provide that a full year?s ?credit? is fully earned so long as the employee was employed for 180 days in the calendar year. And it is possible, too, that a Retirement Plan may provide that an employee has to work only 1000 hours to earn a year?s credit toward retirement. Be careful in your reading, and just as careful in your arithmetic.

3. Does the ?Plan,? Itself, Provide for Bridging? Some pension and retirement plans have express provisions regarding who, in what circumstances, and when employees are eligible for bridging. The most common Plan provisions we see provide that, if an employee is within two (2) years of attaining full retirement status, bridging of some kind will be provided. Other plans provide that, for example, if your age and your years of service together add up to a certain number, such as 65 or 75, then bridging will be permitted. Reading pension and retirement plans may be boring, but reading them can provide a lifetime of financial security, too. Review your Plan carefully, and then read it carefully, again. Incidentally, most Plans don?t use the word bridging, so don?t look for it; instead, the concept is spelled out in words such as ?permitted accommodations,? ?flexibility in calculation,? or ?thinning out? of final employment.

4. Does the Company have a Policy or Practice of Bridging? It?s a good idea to inquire among your colleagues ? especially those who have retired already ? to determine what your company may have done for others in your circumstances, that is, possibly in need of bridging. Arguments for your being granted bridging are especially persuasive if you?ve discovered that bridging has been granted to members of senior management. We?ve found that one of the strongest arguments for ?bridging? is that the Company has done it for others, and so should do it for you.

5. Have You Been Assured that You Would Be ?Kept On Board? to Retirement (or Vesting)? It?s not uncommon for people to start worrying about full vesting in retirement or pension years before they are at the ?doorstep of transition.? If you?ve previously been told ?Not to worry,? or ?Don?t fret? you?re safe,? or things of that nature, you may have a convincing argument that you?ve remained with the company in reliance upon those assurances, and so have earned the right to either remain employed over the full period necessary to vest, or to bridging so as to be treated that way. In fact, we always counsel those in the 47 to 52 age range to consider making inquiries on this very subject ? preferably in email ? to gain exactly this kind of leverage for use in later years, should the need arise.

6. Is the Timing of Your Departure Immovable; If so, Why? One thing you will never see ?written in stone? in a retirement or pension Plan is the exact date by which you must officially no longer be an employee. The determination of your last date of employment is always a matter of your employer?s discretion. By simply postponing your final date of departure, you can often achieve your goal ? full vesting in retirement or pension. So if you receive notice of your position being eliminated as of December 31, and your vesting does not take place until May 15, don?t be shy about asking to remain the necessary four-and-one half months. If told that this is not possible, always ask ?Why not?? More than once our clients have asked that very same question, and then been told, ?Now that you ask, I guess we could consider that.?

7. Might a Different Job be Available? Even if your job is being shipped overseas, or your entire department is being closed down, each on a certain, immovable date, might your skills be transferable and utilized by a different department of your company, even if it?s just for a few weeks or months? In this way, you may find that extra time to get you bridged, not by a bridging accommodation, but by simply working for your salary and benefits, and the added time and credits to achieve that ?big benefit? that may otherwise be scheduled to soon vest.

8. Remember that Retiree ?Treatment? does Not Require Retiree ?Status.? Don?t get confused between the words ?treatment? and ?status.? Said differently, you may be given the ?treatment? given to those who qualify for full retirement benefits even though you have not attained the ?status? of full retiree. By ?treatment,? we mean that you are getting the benefits of a fully vested person. By ?status,? we mean you are, in actuality, a fully vested person. It is not necessary to be a fully vested person in order to be treated like one. (As an analogy, even if I am not, in reality, a king, I can still ask to be treated like one, at least for a day.) Human Resources representatives are fond of confusing these two concepts and, in the process, convincing employees that ?you cannot be treated like a fully vested person if you are not a fully vested person.? That?s exactly the reason behind asking for a ?bridge?: to have you receive full vesting or retirement ?treatment? even though, technically, you don?t qualify for the ?status.? Keep the two different notions in mind, and clearly apart.

9. Might Your Job Loss ? Just Months Short of Vesting ? Be the Result of Intentional ?Targeting?? One issue to carefully consider is whether you may have been chosen to be fired, downsized or laid off for the very purpose of denying you your pension or retirement rights. It is sometimes troubling to consider how many people are treated in just this very way. While such conduct by employers violates both Federal and State laws, the enormous savings achieved by reducing the number of people who will achieve full retirement and pension is so great as to tempt many employers. If you think that this might be the case, don?t be afraid to raise the issue, and if necessary, seek a consultation with an experienced employment law attorney.

10. Consider an Appeal to Basic Fairness, Especially ?At The Top.? Even if you are faced with a Plan that does not permit ?bridging,? and even if bridging has never been granted to other employees before, and even if you?ve never been assured that you would remain on the job until retirement, you can always fall back on the concept of simple, basic, fundamental fairness to request that a ?bridge to retirement? be provided to you. Every single retirement or pension Plan I?ve ever reviewed contains a provision (usually to be found at the very back of the Plan) that provides the Plan Administrator, or the Compensation Committee with flexibility in exercising their duties. These are usually worded to grant the Plan Administrator or the Compensation Committee ?the right to make such modifications in application of the terms and provisions of the Plan as, in their sole discretion, they find necessary or appropriate under the circumstances.? This is the closest thing you?ll ever find to an open invitation to make a heartfelt request, based upon your own unique life circumstances, to be treated as a special case. For example, if you gave twenty-nine years of service to your employer, but missed vesting in full retirement because of a mere paperwork glitch, your bringing this to the attention of the Plan Administrator might very well get you the small ?bridge? you may need.

11. Consider, Too, Using What We Call the ?Doctrine of Cash Equivalents.? In negotiating for certain workplace benefits such as pension ?bridges,? we are at times faced with an abject refusal to deviate from the terms and provisions of a benefit ?Plan.? It is sometimes presented to us that ?The Plan does not allow that, and we just don?t deviate from the Plan.? In these instances, we come right back with the most effective response: ?Well, surely there is no reason that you can?t make up the loss to our client in some other way? especially by paying her, in ?cash? an amount equivalent to her losses.? Given that ?will,? this is the easiest ?way? to get to the same place a ?bridge? would take us.

12. Finally, Remember that in Workplace Negotiating ?Email is Your Faithful Friend.? One thing to always bear in mind about workplace negotiating is that using email to communicate is to your advantage. First, it is ?forever.? That is, it is nearly impossible to delete or lose an email; no matter what someone does, an email trail always exists. Second, people often feel ?unguarded? when writing emails, or responding to them, and so are more open, honest and frank in email correspondence. Third, they are so very easily transmitted, printed and stored. Remember that, in contrast, what you say using your lips can be easily heard wrong, denied, forgotten, mischaracterized, or misplaced. Whatever you do in connection with negotiating a ?bridge to retirement,? do it in email.

The Internet Industry Association today announced the framework that would underpin its imminent code relating to child abuse materials.

The voluntary industry code of practice for ISPs in Australia would entail blocking child pornography sites which would otherwise be available to Australians. It would rely on a blocklist compiled and supplied by Interpol, in cooperation with the Australian Federal Police (?AFP?).

Consistent with industry commitments made almost 12 months ago to develop a voluntary industry program to block child abuse materials, the IIA announced the final elements of the scheme were moving into place in preparation for a launch of the code in July.

IIA member ISPs in Australia have confirmed their intentions to support a code based approach.

?We anticipate that we will have ISPs representing between 80-90% of the Australian user base complying with the scheme this year,? said IIA?s chief executive Peter Coroneos.

Elements of the scheme

The scheme will be limited to child abuse sites supplied by Interpol
Interpol sets out the criteria for list inclusion as follows:
The children are real. Sites containing only computer generated, morphed, drawn or pseudo images are not included.
The ages of the children depicted in sexually exploitative situations are (or appear to be) younger than 13 years.
The abuses are considered by Interpol to be severe constituting the ?worst of the worst? activities involving children.
ISPs who block access to sites would be doing so in accordance with a legal request for assistance under Australia?s existing Telecommunications Act (section 313); no new laws will be required to implement this scheme
Browsers which have attempted to access blocked sites will be directed to an Interpol page explaining why the site has been blocked;
Because of the possibility of accidental access to blocked sites, users will not be tracked or reported under the scheme.

Accuracy and accountability
The list of sites is compiled on the basis of manual checks by police whose experience shows that child sexual abuse material is normally not co-hosted with legal material; it usually resides on specific domains created for the sole purpose of distributing the files. The domains have been reviewed and found to fulfill the above criteria by at least two independent agencies. Users who believe a page is incorrectly blocked can refer the request to AFP/Interpol for review. The current role of the ACMA in receiving complaints from Australian users will continue.

Expected outcomes from the scheme
Both industry and law enforcement agencies recognise that these measures will not stop all child abuse material distribution, but will still achieve a number of significant outcomes, including:

limiting ?revictimisation? of children whose images of abuse have been circulated online
freeing police resources for victim and criminal identification and deleting the material from the hosting service, rather than handling reports about the content itself
preventing accidental and unwanted exposure to child abuse materials, the possession of which is a criminal offence in most jurisdictions including Australia
making deliberate access to illegal web based material more difficult
bringing Australian into line with best practice internationally.

?While we fundamentally maintain the internet is predominantly safe and useful, we acknowledge community and law enforcement concerns about access to illegal materials online, particularly child pornography and so we are taking these practical steps to help make a positive difference?

Happiness a Key to Long Life for Humans and Orangutans (LiveScience.com)

Past research suggested that happy people live longer. To see if this also held true in our ape relatives, scientists asked zookeepers starting seven years ago to rate the happiness of 172 captive orangutans, including 89 Sumatran orangutans (Pongo abelii), 53 Bornean orangutans (Pongo pygmaeus) and 30 hybrid orangutans.

The keepers noted how often the apes were in good moods or bad moods, how much they enjoyed social interactions and whether the apes were effective at achieving their goals, such as getting certain items they want. The zookeepers were also asked to speculate how happy they would be if they were "in the shoes of" each of the orangutans in their care, a question meant to analyze "a more general sense of the individual orangutan's well-being," said researcher Alexander Weiss, a primatologist at the University of Edinburgh in Scotland.

The scientists found that orangutans who scored happier were significantly more likely to be alive up to seven years later. This effect remained even when factors such as sex, age, species and number of times they were transferred to new facilities were taken into account.

"Impressions of the well-being or happiness of orangutans ? and likely other species ? should not be dismissed as being wishful thinking or anthropomorphism," Weiss told LiveScience. "Instead, these impressions should be thought of as valid indicators of an animal's welfare and should be taken seriously."

Although researchers find it unlikely that good spirits cause longer life in orangutans, the happiness of captive orangutans might give indications as to the state of their health and welfare. As such, it could become a valuable tool for ensuring their future health, happiness and survival.

"One possibility is that lower happiness may be an early signal for underlying health problems or health problems that are not detected in ordinary screens. If this is the case, orangutans in captivity who exhibit lower subjective well-being could have their health more closely or more regularly screened," Weiss said. "Another possibility is that an orangutan's happiness reflects their being in a stressful physical or social environment and that this situation also leads to poorer health and a shorter life. If so, working to improve their environment could lead to better health and well-being."

This line of research could also yield insights into the role of happiness not just in orangutans but also in our distant ancestors.

"The findings suggest that measures of well-being or happiness such as these may be getting at the same phenomenon in humans and orangutans with whom we shared a common ancestor around 14 million years ago," Weiss said. "As such, it may be possible to study the evolution of something thought of as fairly subjective and ephemeral by some."

Such research "across a wide range of species could yield fascinating insights into the evolutionary basis of happiness, depression and a host of other psychological characteristics that impact the lives of humans and, most likely, a range of other species," Weiss added.

"Once the mechanisms and evolutionary bases of happiness are better understood, I would like to set up intervention studies to see whether happiness in orangutans or other species can be improved," he added. Weiss also hopes to figure out the mechanisms underlying the relationship between happiness and longevity.

The scientists detailed their findings online June 29 in the journal Biology Letters.

He also looked at countries that have high and low incidences of bowel cancer, and found that in countries where red meat is eaten, but predominantly not beef (ie mutton or goat), incidences are still relatively low compared to North America, Europe and Australia, where the incidence is high.

Lastly, zur Hausen considered that beef is often cooked 'rare', and that this could affect the ability of viruses to survive cooking. He said that papillomavirus, polyvirus and single strand DNA viruses can endure a roasting at 80 degrees Celcuis for 30 minutes. Much beef is cooked more lightly than this. And zur Hausen's hypothesis may explain the rise in bowel cancer cases in Japan, where the staple protein is traditionally fish, rather than beef. ?

Zur Husen says that if we can find an infection that causes colorectal cancer, then 35 per cent of the world's cancer cases could be traced back to an infection. At the moment, 21 per cent of cancers are known to stem from infections, including Hepatitis B, Helicobacter, Schistosoma. And, of course, zur Hausen won his Nobel prize in 2008 by proving that?high risk HPV virus causes cervical cancer.?The cancer of the cervix is the second most frequent cancer in women with 530,000 cases a year, globally - and 86 per cent of these cases are in developing countries.?

The first vaccine to prevent cancer was the Hepatitis B vaccine, developed in Taiwan in 1984. But the vaccine everyone's talking about is the HPV vaccine, which can protect close to 100 per cent of previously non-exposed women, and likewise prevents the infection of cervical precursor lesions.?Zur Hausen said that high risk HPV can be completely eliminated if all girls are vaccinated before reaching sexual maturity - and the vaccination of boys will close the circle of infection.?

Madoff Trustee Irving Picard Triples JPMorgan Lawsuit To $19 Billion

NEW YORK (Jonathan Stempel and Jochelle Mendonca) - The trustee seeking money for Bernard Madoff's victims is now demanding $19 billion in damages from JPMorgan Chase & Co, more than tripling what he hopes to recover from what had been the main bank for the now-imprisoned Ponzi schemer.

The amended complaint by the trustee Irving Picard adds new charges and was filed three days after the second-largest U.S. bank agreed to pay $153.6 million to settle U.S. Securities and Exchange Commission fraud charges.

Picard maintained that JPMorgan was "thoroughly complicit" in Madoff's fraud and ignored red flags. In his original complaint, made public in February, he had sought $6.4 billion, including $5.4 billion of damages and $1 billion for fraudulent transfers and claims.

"JPMorgan Chase chose to enable Madoff's fraud, not just through the various ways it participated in its activity, but by helping to cover Madoff's naked theft with the imprimatur of a globally recognized financial institution," the 155-page amended complaint said.

The higher damage request reflects "life-to-date damages," or what the trustee considers the minimum losses over the entirety of Madoff's Ponzi scheme.

Picard is also seeking at least $500 million that JPMorgan made "off the backs of Madoff's victims," and more than $400 million of alleged fraudulent transfers.

Tasha Pelio, a JPMorgan spokeswoman, repeated in an email the bank's earlier statement that Picard's lawsuit is meritless and distorts the facts and law.

"JPMorgan did not know about or in any way become a party to the fraud orchestrated by Bernard Madoff," she said. "At all times, JPMorgan complied fully with all laws and regulations governing bank accounts."

Picard has filed roughly 1,050 lawsuits seeking more than $100 billion for former investors at Bernard L. Madoff Investment Securities LLC.

"BEFORE THEIR VERY EYES"

The amended JPMorgan complaint adds new allegations that another financial services company around 1997 investigated nearly daily transfers of $1 million to $10 million between Madoff's account there and his account at Chase.

It said that company questioned Madoff's employees about the suspicious back-and-forth transfers. Having failed to be satisfied about them, they closed Madoff's account, it said.

"JPMorgan Chase's bankers literally watched the fraud unfold before their very eyes," Deborah Renner, a lawyer representing Picard, said in a statement. Both are partners at the law firm Baker & Hostetler.

The amended complaint also discusses Madoff's longtime relationship with Sterling Equities, a private banking customer of JPMorgan founded by Fred Wilpon and Saul Katz, owners of the New York Mets baseball team.

Picard has sued the Mets' owners for $1 billion, prompting them to enter talks to sell part of the team to hedge fund manager David Einhorn for $200 million. [ID:nN26247232] The owners have denied knowing Madoff was committing fraud.

In a regulatory filing last month, JPMorgan estimated that as of March 31 it might have to pay out as much as $4.5 billion more for litigation than it had set aside for that purpose. It also said it faced more than 10,000 legal proceedings.

Tuesday's SEC accord resolved charges that JPMorgan did not tell investors that a hedge fund helped shape -- and then bet against -- complex mortgage securities they bought.

HSBC, BANK MEDICI, UNICREDIT ALSO SUED

Picard's case against JPMorgan is being overseen by U.S. District Judge Colleen McMahon.

It is one of three high-profile Madoff lawsuits that have been moved to federal district court, where juries can hear cases, from bankruptcy court, where Picard originally sued.

U.S. District Judge Jed Rakoff is reviewing some issues in Picard's $9 billion case against HSBC Holdings Plc.

Rakoff is also considering whether the trustee can invoke racketeering law in a $58.8 billion lawsuit against Italy's UniCredit SpA, Austria's Bank Medici AG and its founder Sonja Kohn, and other defendants.

JPMorgan has until August 1 to respond to the amended complaint, Picard said.

Madoff, 73, was arrested on December 11, 2008, and after pleading guilty is serving a 150-year prison sentence.

JPMorgan shares fell 16 cents in after-hours trading, after closing Friday's session down 58 cents at $39.49.

Amanda Knox and her ex-boyfriend did kill Meredith Kercher, the first man convicted of the Briton's murder has told an Italian appeal court.

In dramatic courtroom scenes, Rudy Guede confirmed that he believed the US student killed her housemate.

Knox responded by standing up and saying she was "shocked and anguished".

Knox, 23, and her ex-boyfriend Rafaelle Sollecito, 26, are appealing against their convictions for killing Meredith Kercher, 21, in Perugia in 2007.

Miss Kercher, of Coulsdon, Surrey, was found with her throat cut at her Perugia flat after what prosecutors claimed was a sex game taken to the extreme.

Knox is serving a 26-year sentence for Miss Kercher's murder while her Italian co-defendant Sollecito was sentenced to 25 years.

Guede told the court that claims by a fellow prison inmate that he thought Knox and Sollecito were innocent were not true. He said he never made that claim to the inmate.

On 18 June, convicted child killer Mario Alessi told the appeal Guede had confided that Knox and Sollecito were innocent.

According to Alessi, Guede said he and a friend went to the house Miss Kercher shared with Knox with the intent of having sex with Miss Kercher and that when she refused, the scene turned violent and his unnamed accomplice slit her throat.

Drug-dealer Guede was jailed for 30 years for the sexual assault and murder of Miss Kercher after a separate fast-track trial. His sentence was reduced to 16 years on appeal.

Guede was in the witness stand as his letter was read to the court on Monday.

"This splendid, marvellous girl was killed by Raffaele Sollecito and Amanda Knox," the letter said.

Guede has previously admitted being in the house at the time of the murder, but denies involvement in Miss Kercher's death.

After cross-examination by the defence, Guede is reported to have said he had always believed Sollecito and Knox were behind the murder.

"I've always said who was there in that house on that cursed night," he told the court.

BBC correspondent Duncan Kennedy said it was the first time since the killing four years ago that all three defendants had given evidence on the same day and there were "dramatic scenes" in court.

Knox stood up after Guede's evidence and denied his claims.

"The only time that Rudy Guede, Raffaele and I were in the same space has been in court. I'm shocked and anguished.

"He knows we weren't there and have nothing to do with it," she said.

Sollecito said Guede was always talking "about a shadow that could be me and a voice that could be Amanda's... we've been fighting shadows for four years. Our lives have been destroyed in a subtle and absurd way."

Speaking before Monday's hearing, Knox's mother Edda Mellas told reporters she hoped that Guede would have the "integrity to stand up and tell the truth".

She said her daughter was "always very anxious and nervous but I think she's glad things are moving along. She feels things are going well," but that it is, "hard to get too hopeful, especially after the first trial."

Hacking suspect 'has Asperger's'

A 19-year-old charged with hacking the website of the UK Serious Organised Crime Agency has been diagnosed with Asperger's syndrome, a court has heard.

Ryan Cleary, from Wickford, Essex, was arrested as part of a Scotland Yard and FBI probe into online hacking group LulzSec.

His counsel told City of Westminster Magistrates' Court he suffers from the form of autism, along with agoraphobia.

He was granted bail, but remains in custody after prosecutors objected.

Ben Cooper, defending Mr Cleary, said he was concerned the alleged hacker would have to remain in custody over the weekend.

The court was told he is of high intelligence but has difficulty interacting with other people.

But prosecutors refused to reconsider their bail appeal.

Mr Cleary is alleged to have set up a distributed denial of service (DDOS) attack on the Serious Organised Crime Agency (Soca) on 20 June.

A DDOS attack typically involves flooding a target website with data, in an attempt to overwhelm it so it cannot serve its legitimate users.

He has been accused of attacking the website of the International Federation of the Phonographic Industry in November 2010.

And Mr Cleary also allegedly attacked the British Phonographic Industry's website in October.

He was charged under the Criminal Law Act and Computer Misuse Act by the Met Police's e-crime unit.

The charges against Mr Cleary include conspiring with other unknown people on or before 20 June to construct a botnet - a collection of hijacked home computers - to conduct distributed denial of service attacks.

He is also charged with making, adapting, supplying or offering to supply a botnet, intending that it should be used to commit, or to assist in the commission of a distributed denial of service attack.

The bail appeal will go to a Plea and Case Management Hearing at Southwark Crown Court on 30 August.

If Mr Cleary wins bail he will be banned from having any possession which can access the internet.

No internet access will be allowed at his home, which he will be prohibited from leaving without his mother, Rita Cleary.

Mr Cleary has not entered a plea to any of the charges.

I think that effective communication is among the most important skill needed for relationships to function well. Learning effective communication skills helps couples to learn to talk politely, to better understand each other, to care for one another, to help each person to feel more connected to the other person and to deal effectively with problem solving a variety of issues.

Effective communication that helps around supporting feelings and caring for one another may be required before good problem solving strategies will even be effective. I also believe that fewer relationships end when people care and interact supportively but cannot work out certain issues, than relationships that problem solve well but are cold and distant. Men may be guiltier of the tendency to want to overly problem solve issues while discussing and supporting feelings less during communication.

?We were all raised in an environment that probably left at least some deficits in our ability to communicate and many of us seem to have been raised in environments that had large deficits in communication.

Unfortunately a significant amount of problematic conflict or lost connection in relationship can occur because of poor or ineffective communication. We may find ourselves involved with people and places where our current communication abilities work to some extent and reduce the level of conflict in our lives. Unfortunately these abilities may not be effective for deeper or long term in-depth communication such as in a significant relationship.

Significant relationships, which typically require good in-depth communication for the people in the relationship to be continually developing and growing together and to work through conflict effectively, will often expose the deficits we have in our ability to communicate.

Typically a healthy, growing person will also be constantly looking to improve their relationships and communication, even if the current level of communication in their relationship is good or reasonable. The following are the areas I think address a number of common mistakes made in communication and suggest guidelines and ideas that lead to better communication.

?Good listening in this context is more of a passive skill and involves that the person who is listening does not interrupt, talk over another person or give any indications that they are not listening. Instead, they will hear what the person is saying and let the other person comfortably finish whatever it is that they are talking about.

The person will not interrupt, which can be done verbally, i.e. talking at the same time as someone else is talking, or non-verbally, i.e. rolling their eyes or walking away while the person is still speaking. Good listening may involve making eye contact, offering encouraging words or gestures and avoiding words or actions that will not support the person who is talking to be able to freely and fully express whatever it is that they want to say.

?In the context described here good acknowledging is more of an active skill. Acknowledging someone means you have heard and understood the person and can then give the person feedback that you have heard and understood them. One method to let a person know you have heard and understood them is by repeating back what they have said in as complete and natural a way as possible.

Being able to repeat back the details about the issues and feelings that another person wants to be heard about is an important skill. Repeating back allows the other person to know you have paid attention to and have understood what they have said. If feelings and content are both shared by the person speaking, the listener can acknowledge both the feelings and the content. For example, the listener may say that they heard how disappointed that the other person was that a trip they were looking forward to was cancelled.

The listener can also acknowledge only the feelings or only the content if that is what they heard. For example the listener may state that they heard the feelings of disappointment or they may state that they heard that the trip was cancelled. Essential to paraphrasing is that the listener not just hears the speaker but supports, advocates and shows interest in what the person is saying which may be demonstrated by asking further questions or by responding with an animated tone.

Coldly repeating back what someone has said may discourage further openness and discussion. Adding your ideas or giving your interpretation about the feelings or issues the other person expressed, even if you are correct, before simply giving an acknowledgment may leave the person feeling unheard. For example, the person may state that they felt hurt when the other person walked away during a discussion.

A response that adds how hurt the person was because walking away reminds them of other people who walked away on them provides an unstated interpretation. The person did not mention anything about other people walking away on them which can leave the person feeling unheard about what they did say. A complete acknowledgment should be given to what was said before a response is offered.

For example, a simple acknowledgment may sound like, ?I hear you are hurt by my walking away? and stating nothing further. I believe it is also important that the person who shared their feelings or issues has said or shown that they feel heard before the listener starts to talk about their feelings or issues.
