High court has options on health care law

(AP) ? The arguments are done and the case has been submitted, as Chief Justice John Roberts says at the end of every Supreme Court argument. Now the justices will wrestle with what to do with President Barack Obama's health care overhaul. They have a range of options, from upholding the law to striking it down in its entirety. The court also could avoid deciding the law's constitutionality at all, although that prospect seems remote after this week's arguments.

A look at six potential outcomes, from the simplest to the most complicated possible rulings:

Q. What if the Supreme Court upholds the law and finds Congress was within its authority to require most people to have health insurance or pay a penalty?

A. A decision in favor of the law would end the legal fight and allow the administration to push forward with implementing its provisions over the next few years, including the insurance requirement, an expansion of Medicaid and a ban on private insurers' denying coverage to people with pre-existing health problems.

The political wrangling, however, probably would continue as candidates for Republican presidential nomination and lesser offices are calling for repeal of the law.

Q. What if, on the other hand, the court strikes down the entire law?

A. That would kill a costly new federal entitlement before it has a chance to take root and develop a constituency of beneficiaries and supporters, namely more than 30 million people who are supposed to wind up with health insurance because of the law.

In addition, some parts of the law already are in effect and would be rolled back. One popular provision allowing young adults to stay on their parents' insurance until age 26 has added nearly 2.5 million people to the coverage rolls, at no cost to taxpayers.

But there's no escaping America's double-barreled problem of excruciatingly high health care costs and many uninsured people, more than 50 million according to the latest estimates.

Whether it's dealing with the federal deficit, retirement security for seniors or even the Pentagon budget, elected officials would still have to confront health care at nearly every turn.

Congress would get to roll the ball up the hill again.

Q. What happens if the court strikes down the individual insurance requirement, but leaves the rest of the Affordable Care Act in place?

A. Knocking out the requirement that Americans carry insurance would not be the end of Obama's health care overhaul. There's a lot more in the 900-plus pages of the law.

But it would make the complicated legislation a lot harder to carry out, risking more complications for a U.S. health care system already seen as wasteful, unaffordable and unable to deliver consistently high quality.

Ten million to 15 million uninsured people who would have gotten coverage under the law could be left out.

The cost of individually purchased private health insurance would jump. That would make it more expensive for the government to subsidize premiums, although millions of middle-class people would still be entitled to such assistance under the law's remaining provisions.

If the individual mandate is struck, the law's Medicaid expansion would still cover millions more low-income people, mainly childless adults.

And a host of other mandates would stay in place. Starting in 2014, medium-sized and large employers would be hit with fines for not providing coverage to their workers.

Insurance companies would be required to accept people with pre-existing medical problems, no longer allowed to cherry-pick the healthy to keep costs down. They would also be barred from imposing higher premiums on people in poor health and limited in what they could charge older adults.

If that happens, premiums in the individual health insurance market would jump anywhere from 10 percent to 30 percent, according to various forecasts from economists.

Experts debate whether or not such a cost spike would trigger the collapse of the insurance market for individuals and small businesses ? or just make coverage even more expensive than it already is.

"Without a mandate the law is a lot less effective," said MIT economist Jonathan Gruber, who advised the Obama administration and, earlier on, then-Massachusetts Gov. Mitt Romney, who put such an insurance mandate in that state's health care law. "The market will not collapse, but it will be a ton more expensive and cover many fewer people."

Q. What if the court strikes down the mandate and invalidates the parts of the law that require insurance companies to cover people regardless of medical problems and that limit what they can charge older people?

A. Many fewer people would get covered, but the health insurance industry would avoid a dire financial hit.

Insurers would be able to continue screening out people with a history of medical problems, such as diabetes patients or cancer survivors.

That would prevent a sudden jump in premiums. But it would leave consumers with no assurance that they can get health insurance when they need it, a major problem the law was intended to fix. Other economically developed countries guarantee health insurance for their citizens.

A related requirement limits premiums charged to older adults. Currently people in their late 50s and early 60s can face premiums as much as six or seven times higher than those charged to 20-year-olds. The law says insurers may charge older adults no more than three times what they charge younger ones.

Administration lawyers say the insurance requirement goes hand in hand with the coverage guarantee and cap on premiums, and have asked the court to get rid of both if it finds the mandate to be unconstitutional.

Q. What happens if the court throws out only the expansion of the Medicaid program?

A. Throwing out the expansion would severely limit the law's impact because roughly half of the more than 30 million people expected to gain health insurance under the law would get it through the expansion of Medicaid, the federal-state health insurance program for low-income people.

The law would effectively bring under Medicaid everyone making up to 138 percent of the federal poverty level. That works out to about $15,400 for an individual, $30,650 for a family of four. Most of those who would be added to the Medicaid rolls are low-income adults without children.

But a potentially sizable number of those low-income people might still be eligible for government-subsidized ? though probably more expensive ? private insurance under other provisions of the law. Private coverage will probably be more expensive for taxpayers to subsidize than Medicaid.

States suing to overturn the federal law argue that the Medicaid expansion comes with so many strings attached it amounts to an unconstitutional power grab by Washington, reaching directly into the wallets of state taxpayers.

The administration counters that the federal government is paying all of the initial cost of the expansion and 90 percent in perpetuity, well above what Washington contributes for regular Medicaid. Moreover, when Congress created Medicaid in 1965 it also served notice on the states that program rules could change in the future. This is only the latest of many such changes.

The Supreme Court took on this issue even though none of the district or appeals courts that heard health care lawsuits had any problem with the Medicaid expansion.

"We don't have any lower court that has struck down this (Medicaid) provision, so there is no precedent from the lower courts on how to handle it," said Diane Rowland, a Medicaid expert with the nonpartisan Kaiser Family Foundation. "They all upheld it."

Q. What happens if the court decides that the constitutional challenge is premature?

A. The wild card, and least conclusive outcome in the case, probably also is the least likely, based on what justices said during the arguments. No justice seemed inclined to take this path, which involves the court's consideration of a technical issue. The federal appeals court in Richmond, Va., held that the challenge to the insurance requirement has to wait until people start paying the penalty for not purchasing insurance. The appeals court said it was bound by the federal Anti-Injunction Act, which is intended to facilitate tax collections and keep the government operating. That law says federal courts may not hear challenges to taxes, or anything that looks like a tax, until after they are paid.

It remains at least possible that if the justices have trouble coming together on any of the other options they could simply decide not to decide the big issues.

Although the administration says it doesn't want this result, such a decision would allow it to continue putting the law in place and force postponement of any subsequent challenge until more of the benefits are being received. On the other hand, Republicans might have more ammunition to press for repeal of the law in the meantime.

Dogs learn to respect the pack leader in the wild by being dominated, not attacked. Physical punishment can lead to an irrational and often violent pet.

Do not train your dog when you are angry or stressed. Not only will you have less patience, but dogs are incredibly receptive to their owner?s moods. By skipping training when you are not at your best, you can be sure when you do train, it will be much more effective.

Being a proactive pet owner is the first step in training your pooch. An owner who anticipates troublesome situations for their dog, and works to keep him away from those situations whenever possible, will have a better behaved animal. Extensive training will not be as necessary if you get to know your dog so you can anticipate his actions.

Understand that training takes time. A lot of people make the mistake of thinking a dog is ?untrainable? when things don?t go according to plan immediately. Some dogs respond to commands sooner than others, and it is usually according to breed and age. If you have adopted an older dog, it may take a long time, as he will already be set in his ways. Remember to be patient, and understand that a dog always wants to please his owner in the long run.

Your dog will benefit from having a strong leader. Be confident in your ability to communicate with your dog! You two may speak different languages, but your physical gestures have more meaning than you think. Stand straight during training sessions and always make physical gestures clearly. I am a big fan of legal immigration and I am a realist on illegal immigration.

?

While I don?t necessarily love amnesty programs because I think they encourage more illegal immigration, I believe that if you have been here for twenty years and that you have been a good and productive citizen and if you have a bunch of family here, you ought to be given a quick path to citizenship without being forced to leave the country.

?

I know there are haters out there who hate that position (and probably hate me as a result), but I don?t really care about the haters.

?

Of course, I am not an elected politician either.? And if you are an elected politician, especially if you are a Republican, you have to care about the haters, because they tend to vote on issues like immigration.

?

The Republican Party finds itself in a bit of a quandary when it comes to this issue.? They desperately want to do better among Hispanic voters, but they can?t seem to come to grips with the necessity of softening its position on immigration.

?

Marco Rubio knows better than most about how this issue cuts.? Like his predecessor Mel Martinez, Rubio is a Cuban and a rising star in the GOP who wants to take some common-sense steps forward on the legal immigration.

?

Mel focused on this issue when he was Chairman of the Republican National Committee, and he actually worked with John McCain and Ted Kennedy to come up with a bipartisan plan.? The result?? Donations to the RNC dried up, and Martinez was viciously attacked from the right-wingers.

?

According to press reports, Rubio is picking up the dropped baton from Martinez and running with it.? He is working with Jon Kyl and Kay Bailey Hutchison to develop a Republican version of the Dream Act, and to include other provisions that will prop up the American economy by attracting top talent and investment from overseas.

?

I salute Mr. Rubio for his efforts and I hope that the Republican Party has learned that it can?t just hope that Hispanic voters vote for the GOP because President Obama has done nothing on immigration (and actually nothing to help Hispanics in this country).

?

The Republican Party can adopt both a pro-immigrant philosophy and a pro-law and order philosophy.? It can welcome immigrants to this country who obey the law and plan on being productive members of society, while being tough on those immigrants who join gangs or promote drug-trafficking.? It can promote policies that make it easier for immigrants to assimilate and get greater access to the American dream.? But it can also work to make certain that immigrants are not exploited at slave-labor wages and make it harder to illegal immigrants to get welfare benefits.

?

And it can promote policies that keep new engineering and computer science doctoral students in the country instead of requiring them to move back home to our competitors.

?

I think that is where Rubio is trying to take the GOP, and for that I give him a big thumbs up.

(AP) ? Anthony Davis is The Associated Press' college basketball Player of the Year, the first Kentucky player and second freshman to win the award.

He received 43 votes Friday from the 65-member national media panel that selects the weekly Top 25. Balloting was done before the NCAA tournament.

The 6-foot-10 player from Chicago is the Southeastern Conference's Player, Freshman and Defensive Player of the Year. He averaged 14.3 points, 10.0 rebounds and 4.6 blocks while shooting 64.2 percent. His block total is a school record and third best for a freshman.

Kevin Durant of Texas in 2007 is the only other freshman to win the award.

Thomas Robinson of Kansas was second with 20 votes, and Draymond Green of Michigan State received the other two votes.

Jimmer Fredette of BYU won the award last season.

Mumbai, Miami on list for big weather disasters

(AP) ? A new scientific report warns that global warming is causing more extreme storms and droughts and that the world should prepare for an unprecedented onslaught of deadly and costly disasters.

The report says the greatest danger is in highly populated, poor regions of the world, but no region is immune. The document by a Nobel Prize-winning panel of climate scientists forecasts stronger tropical cyclones and more frequent heat waves, deluges and droughts. The 594-page report released Wednesday blames a combination of man-made climate change, population shifts and poverty.

The scientists say that some places, particularly parts of Mumbai in India, could become uninhabitable from floods, storms and rising seas. Other cities at lesser risk include Miami, Shanghai, Bangkok, China's Guangzhou, Vietnam's Ho Chi Minh City and India's Kolkata.

The CEO of JetBlue said on Wednesday he personally knows the pilot whose erratic behavior led to a diverted flight and that there were no earlier signs of problems, although the airline will review its procedures after the incident.

A JetBlue flight bound for Las Vegas from New York had to make an emergency landing in Amarillo, Texas on Tuesday after what passengers described as chaos mid-flight when Captain Clayton Osbon was locked out of the cockpit.

Aviation experts say that such incidents are rare. John Cox, an aviation safety consultant and former airline pilot, told the Associated Press that incidents in which pilots become mentally incapacitated during a flight are "pretty rare." He said he could only recall two or three other examples in the more than 40 years he has been following commercial aviation.

Passenger video of the situation shows Osbon ranting about Israel and Iran, among other things.

JetBlue CEO Dave Barger described it as a medical situation that turned into a security one. He said he did not think anyone from the company has since talked to Osbon.

"The captain's now in the hands of medical care, obviously, under the custody of the FBI," Barger said told NBC's "Today" program.

"I've known the captain personally for a long period of time and there's been no indication of this at all," Barger said, adding that the pilot was a "consummate professional."

Barger said, "We'll always take a look at procedures ... but I'm very confident about our procedures, the industry's procedures."

He credited the training of another pilot and other cabin crew staff in handling the situation on the flight which had 135 passengers.

Passengers described a chaotic mid-flight scene in which a man in a JetBlue uniform, apparently locked out of the cockpit, began banging on the door and demanding to be let inside.

Tony Antolino, a passenger on the flight who helped subdue the pilot, said the plastic restraints on board were flimsy and systematically failed. Passengers on the flight were rattled, and several had to restrain the pilot after his meltdown by sitting on him.

"They did not work, they failed," Antolino told NBC, speaking from Las Vegas. "We had to use seatbelt extenders, people's belts and physically our hands to try and restrain the guy."

Asked if he would review company procedures following the incident, Barger said: "Absolutely, but not just that, but also the entire event ... within JetBlue and also the industry."

The Federal Aviation Administration cited an "onboard medical emergency" as the reason for the diversion, and said preliminary information showed the co-pilot became concerned that the captain had "exhibited erratic behavior during the flight."

"The captain had exited the cockpit during the flight, after which the co-pilot locked the door," the statement said. "When the captain attempted to enter the locked cockpit,he was subdued by passengers."

The incident was the second one involving erratic behavior by a JetBlue crew member since August 2010, when a flight attendant, Steve Slater, bolted from a plane by deploying and sliding down the inflatable emergency chute following an altercation with a passenger.

Ten Desserts for the Budget-Conscious | Taste | Food & Drink ...

Don't misunderstand: I like fine-dining, high-concept restaurant desserts. I don't mind the little artfully placed dabs of sauce; I can even appreciate the jarring flavor combinations.

But sometimes you just want some small sweet thing at the end of a heavy meal. Sometimes you want to grab dessert to go so you can enjoy it in the comfort of your own home. Quite frankly, sometimes you don't want to (or can't afford to) shell out $10 for a showstopper of a composed dessert that might end up being more style than substance.

Fortunately, with all the culinary riches in the East Bay, there's no shortage of desserts that are as outstanding as they are inexpensive, many of them available for three bucks or less. (Note, for the record, that I'm quite liberal in my interpretation of what constitutes "dessert" and have included many pastries and baked goods and such. In my house, anyway, "$3 dessert" is just another way of saying "breakfast fit for a king.")

Without further ado, here are ten of my favorites:

1. Tiramisu Cupcake from Cupkates

For definitive proof that inexpensive desserts can be just as sophisticated as their pricier counterparts, look no further than Cupkates. Headed by "Chief Cupcake Officer" Kate McEachern, the Bay Area's first mobile cupcakery has been slinging its cream-topped wares in Oakland, Berkeley, and Emeryville since 2009 ? well in advance of the current food truck craze.

But cupcakes? Sophisticated? At $3 a pop? Not to worry: The tiramisu cupcake will make you a believer. A deconstruction of the popular Italian dessert, McEachern's cupcake version captures the taste of the original while avoiding the characteristic sogginess that normally makes tiramisu one of my least favorite desserts. So instead of soaking ladyfinger cookies in espresso and booze, she makes a crust out of crushed ladyfingers and bakes that right into the cake itself, then soaks the cake in brewed espresso. This being a kid-friendly cupcakery, McEachern eschews the alcohol altogether, but does nod toward the traditional flavors by topping off the whole thing with a light, barely-sweetened mascarpone frosting.

2. Lemon Ricotta Doughnuts from Go Streatery

You wouldn't think it, but the East Bay's best rendition of those sugar-dusted Italian doughnuts known as zeppole come from a gourmet food truck that's owned and operated by a Vietnamese American. Just about everything on the menu at DanVy Vu's truck, Go Streatery, is tasty, but her lemon ricotta doughnuts ? just $3 for a generous sackful ? are exceptional. What sets these zeppole apart is the contrast between their soft, slightly custardy interior and a crunchy exterior so resilient that the doughnuts never seem to get soggy, even after they've been sitting in the bag for an hour.

Vu says developing her zeppola recipe was a year-long labor of love, inspired by her passion for a savory ? but similarly crispy ? Vietnamese fritter called b?nh cay, and by her husband's childhood memories of his Italian grandmother's zeppole. Vu's then-seven-year-old son served as her chief taster.

"We had a version of zeppola for every occasion," she recalled. "For his birthday that year, I piled a plate high with zeppole and stuck candles in it. He was delighted."

3. Malasadas from Boniere Bakery

Fried-dough lovers should also check out Oakland's Boniere Bakery, where on Fridays and Saturdays you can buy rustic-looking, irregularly-shaped doughnuts called malasadas, still warm from the fryer. These are pillowy little things, covered in cinnamon sugar, with a satisfying chew and crunch to them ? it takes a high level of self-control not to scarf down three or four in one sitting. At 75 cents apiece, they're a flat-out bargain.

Owner Diane Jatczak explains that malasadas come from Portugal by way of Hawaii, where her parents grew up and where the fried treats are quite popular ? especially on Fat Tuesday, when they're traditionally eaten. The malasadas at Boniere are made using a family recipe: Lemon extract and a secret spice blend are added to a basic raised yeast dough, and then the doughnuts are fried, free-form, in hot oil. Need I state the obvious? These go amazingly well with a good cup of coffee.

4. Husband Cakes from Wonder Food Bakery

Pushing the limits of what can rightfully be considered a dessert, we come to the husband cakes (or lao gong bing) at Oakland Chinatown's Wonder Food Bakery. You'll find these circular, black-sesame-seed-flecked pastries (not cakes, really) in a small display case on top of the counter at Wonder Food, and their price ? $1.35 for five! ? makes them arguably the best deal on this entire list. These flaky little pastries have a savory-sweet filling that brings to mind Cantonese barbecued pork; there are even little bits of pork inside. All in all, it's a strangely addictive combination of flavors and textures, and so much better than the latest creation of some pastry chef who's decided to add bacon to everything, willy-nilly.

5. "2nd Street" from Flavor Brigade

Ask folks who grew up on the East Coast about Italian ice or frozen custard, and you're likely to spark fits of nostalgia. For the longest time it was well-nigh impossible to find the stuff in the Bay Area, but then Flavor Brigade opened in Oakland's Dimond District. Owner Braedon Galloway's Italian ices ? or water ices, as they call them in Philly ? are the real deal: like brightly colored, super-smooth sorbets. And his custard ? think ridiculously rich soft-serve ice cream ? is no slouch either. Layer the two together and you get the ultimate hot-weather treat, what Galloway calls the "2nd Street." Three dollars buys you a "small" cup that in any other ice cream parlor would probably be considered a large.

6. Chocolate Pecan Pie from Smoke Berkeley

There aren't a ton of dessert options at Smoke Berkeley, the Texas-style barbecue joint that opened a few months ago on San Pablo Avenue. But Chef Tina Ferguson-Riffe won't hesitate to tell you about the blue ribbons her pies have won at Texas state fairs, and once you taste her chocolate pecan pie ($3.50 a slice) you'll understand why. Smoke's version is more like a slightly oozy fudge brownie ? complete with the crackly top and chock full of pecans ? than a typical pecan pie. It's delicious, but definitely different.

According to Ferguson-Riffe, a traditional pecan pie is loaded with light and dark corn syrups ? hers isn't, which is why it doesn't have the sticky, gooey consistency people associate with the dessert. She also ups the ante by using high-quality Callebaut dark chocolate, from Belgium.

7. Fruit Pie from Crixa Cakes

Only in a food writer's bizarro-world would $5 be considered cheap for a slice of pie, but Crixa's pies are the best. The slices are huge, and eating one all by yourself is as much of a decadent indulgence as any dessert you might get at a restaurant. The price for a slice actually ranges between $4 and $5, depending on what fruits are in season ? my favorites are anything involving stone fruits during the summer months, and Crixa's pumpkin pie (ordered several weeks in advance) has become an annual Thanksgiving tradition. The pies here are a somewhat unusual deep-dish style, perfect for those who love lots of crust. And while the all-butter crust isn't the crisp variety, it is very, very tasty.

8. Orange Tea Cake from La Bedaine

You never know what you'll find in the display case at La Bedaine: tarte tatin, little buttery croissants, those ethereal cream puffs called croquembouche. One of the most wonderful items ? if not the most obviously French ? is Chef Alain Delangle's orange tea cake, each loaf the size of a small pound cake and topped with almonds. It's an incredibly moist and fragrant little cake, and the nuts and the nicely browned exterior provide an appealing textural contrast. Each cake sells for $6, but only a real champion cake-eater would consume the whole thing at once ? it's perfect for sharing with two or three other diners over a pot of hot tea.

9. Chocolate Croissant from Feel Good Bakery

For something more obviously French, try the $3 pain au chocolat from Alameda's Feel Good Bakery ? it's as good a version as you'll find in the East Bay. Biting into one of these bad boys, the first thing you'll notice is the crunch and the buttery little shards that'll fly all over your plate and onto your shirt. This isn't that limp, bready kind of croissant that you find all too often, even at respected bakeries. Just as importantly, Feel Good uses quality E. Guittard dark chocolate in its croissants, and the result is a less-sweet and more intensely chocolaty filling.

10. Bananas Foster Bread Pudding at Angeline's Louisiana Kitchen

I've been known to order bread pudding every single time I see it on a menu, and the Bananas Foster bread pudding at Angeline's Louisiana Kitchen, in Berkeley, is one of the best. This is the restaurant's take on the classic New Orleans combination of bananas, vanilla ice cream, and rum. Here, they've dispensed with the ice cream, folded the bananas into a dense bread pudding, and added the rum to a decadent caramel sauce.

At $6.95, this is on the upper end of my list, but again, it's a dessert clearly meant to be shared. I can testify to having once tried to eat the entire portion myself ? after a gut-busting dinner of barbecued shrimp, hush puppies, and too many glasses of sweet tea. It was, as the kids say, an epic fail.

But that doesn't mean I won't try again.
